The New York Department of Motor Vehicles (DMV) assigns each traffic violation a specified number of points. The more points you accumulate on your driving record, the more sanctions you could potentially face. The points penalties for traffic violations in New York are:
- Reckless driving – 5 points
- Improper cell phone use – 5 points
- Texting – 5 points
- Failure to stop for a school bus – 5 points
- Following too closely/tailgating – 4 points
- Inadequate brakes – 4 points
- Failing to yield right of way – 3 points
- Violating traffic signals, stop signs or yield signs – 3 points
- Railroad crossing violation – 3 points
- Illegal passing – 3 points
- Leaving the scene of an accident involving property damage or animal injury – 3 points
- Seat belt violations for persons under 16 – 3 points
Moving violations other than the ones listed above generally incur 2 points. Speeding violations incur anywhere from three to eight points depending on how far above the posted speed limit you were driving. If you receive more than 10 points during an 18-month period, you may be required to attend a DMV hearing and your license may be suspended or revoked. If you are convicted of a drug or alcohol violation or if you receive more than three speeding tickets within an 18-month period, your license will automatically be suspended or revoked. The effective date for license points is the date of the violation and not the date of conviction.
