Cell phone use while driving is rapidly increasing and often leads to devastating consequences. From 2011 to 2012, the number of tickets issued for texting while driving in New York State increased by 234%. In 2013, several new laws went into effect in New York addressing cell phone use. All drivers are prohibited from using hand-held cell phones while driving. This prohibition includes both making calls and texting. Additional changes in the law include:
- Increased point values – For offenses committed between October 5, 2011 and May 31, 2013, you will receive 3 points. You will receive 5 points for violations committed on or after June 1, 2013.
- Additional penalties for young and probationary drivers – If you hold a learner’s permit, class DJ, or MY, or probationary license, a conviction for a cell phone violation results in a 60-day suspension. A second conviction within 6 months results in a 6 month suspension for probationary drivers and a 60-day revocation for junior drivers.
- Increased fines – Minimum fines for cell phone violations begin at $50 and can go as high as $400 drivers depending on the number of violations you commit within an 18 month period.
- New sanctions for commercial drivers – Commercial drivers are presumed to be committing a cell phone violation if they are observed holding or using a cell phone at any time even when the vehicle is stationary.
