- Second Degree Rape – Engaging in sexual intercourse with someone under the age of 15 or someone who is mentally disabled or incapacitated and therefore incapable of providing consent
- Third Degree Rape – Engaging in sexual intercourse with someone incapable of providing consent for a reason other than being under the age of 17 or incapacity to consent.
